WaveCast provides podcast hosting, distribution, and related services through its website and applications. This includes:

3. User Accounts

To access certain features of our service, you may be required to create a user account. When creating an account, you agree to:

• Use any robot, spider, site search/retrieval application, or other manual or automatic device to retrieve, index, "scrape," "data mine," or in any way gather content or reproduce or circumvent the navigational structure or presentation of the service

5. Intellectual Property Rights

All content included on WaveCast, such as text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of WaveCast or its content suppliers and protected by international copyright laws.

The podcasts available through our service are the property of their respective owners and are protected by copyright and other intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way any material from our service without prior written consent.

6. Subscription and Payment Terms

Some features of WaveCast may require payment of fees. By selecting a premium service, you agree to pay WaveCast the subscription fees indicated for that service.

• Payments are processed through secure third-party payment processors
• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• You may cancel your subscription at any time, but no refunds will be provided for the current billing period
• We reserve the right to change subscription fees at any time with 30 days notice

7. User-Generated Content

WaveCast may allow users to post comments, reviews, and other content. You retain all rights to any content you submit, post, or display on or through our services.

By submitting content to WaveCast, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

You are solely responsible for the content you post and the consequences of posting it. We reserve the right to remove any content that violates these terms.

8. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or delete your account through your account settings.

9. Disclaimer of Warranties

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. WaveCast expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

WaveCast makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, or (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.

10. Limitation of Liability

In no event shall WaveCast, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use or alteration of your transmissions or content

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
